1. Acceptance of Terms
By subscribing to or using any Dhivin Consultancy Pvt. Ltd. ("EldersGuard", "we", "us", "our") product or service, you ("User", "you") agree to be bound by these Terms & Conditions. If you do not agree, you must not use our services.
2. Services Offered
EldersGuard offers smart home security and monitoring services, including but not limited to: IoT sensor connectivity via Zigbee-based hardware, real-time event notifications, cloud activity logging, smart device control, and the EldersGuard elderly monitoring product. Services are accessed via the EldersGuard mobile application and may be governed by additional product-specific agreements.
3. Subscription & Payment
• Services are offered on a monthly subscription basis at the rates displayed on our pricing page.
• All payments are processed securely through Payumoney. EldersGuard does not store your card or payment details.
• Subscriptions automatically renew each month unless cancelled by the user before the renewal date.
• Prices are in Indian Rupees (INR) and are inclusive of applicable taxes.
4. Cancellation & Refund Policy
• You may cancel your subscription at any time through the app or by contacting support.
• Refunds are not issued for partial months already billed. Cancellation takes effect at the end of the current billing period.
• In case of a proven technical failure on our part that prevented service delivery, a pro-rated refund may be considered at our discretion.
5. Hardware Ownership
The Dusun IoT Gateway Hub and Zigbee sensor devices are sold separately and are not included in the subscription. The subscription covers cloud services, mobile app access and ongoing software updates only.
6. Limitation of Liability
EldersGuard is a monitoring and notification service and does not replace professional security systems, emergency services, or physical security measures. We are not liable for any loss, damage or injury arising from events that sensors detected or failed to detect. The maximum liability of EldersGuard to any user shall not exceed the subscription fees paid in the preceding 3 months.
7. User Obligations
• You are responsible for the lawful use of sensors and cameras within your property.
• You must not install sensors in any location where monitoring would violate the privacy of third parties.
• You are responsible for maintaining adequate internet connectivity for the hub.
8. Intellectual Property
All software, content, brand names, logos and intellectual property associated with EldersGuard are the property of Dhivin Consultancy Pvt. Ltd. Unauthorized use, reproduction or distribution is strictly prohibited.
9. Governing Law
These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Chennai, Tamil Nadu.
